RENTAL AGREEMENT

This Short Term Rental Agreement (the “Agreement”) is made by and between Ivey Coast Property Homeowners and “Guest.”   For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1. Property:   The property is located at:  57207 Slash Creek Rd., Hatteras, NC 27943.

2. Rental Party:  The rental party shall consist of only those persons identified in the inquiry sent by the Guest and agreed to in Homeowners response and price quote.  The Guest forming this rental agreement is 25 years or older and will be at the property during the rental period.  No other persons are authorized to stay overnight at the property.

3. Term of the Lease:  The lease begins at 4 p.m. on the agreed upon “Check-in Date” and ends at 10 a.m. on the agreed upon “Check-out Date.”  No early check-in or late check-out, unless prior arrangements have been made.

4. Rental Rules:  Guest agrees to abide by the Rental Rules listed below at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.

•Smoking is allowed outside only.  If Guest violates this rule then special cleaning fee – a minimum of $300 extra – will apply that are not covered by the Accidental Damage Protection.  This will be used to clean furniture and rugs, as well as wipe down the inside of the house.

• People other than those in the Guest party may not stay overnight in the property.  Any other person on the property is the sole responsibility of Guest.  While the Guest is allowed visitors, parties are not permitted.  Any complaints by neighboring property owners regarding noise, parking, trespassing on neighbor’s property, or other disturbances will be taken very seriously.   Depending on the circumstances, Homeowner reserves the right to evict Guest’s rental party with no refund.

• The Homeowners are not responsible for any accidents, injuries, or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

• Guest is responsible to keep the property and all furnishings in good order.

• If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately.

• Pets:  Guests are NOT authorized to bring pets into the house without prior approval of the Homeowners.  Small-to-medium pets will be considered with a non-refundable pet deposit of $75 per dog. If pets are discovered in the home without the Homeowners approval, Tenant will be evicted immediately and without return of any rental fees.  Pet damages will be charged to the Tenant.

• Parking:  Vehicles are to be parked in designated parking areas only.  Parking on the road is not permitted.  Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

• Housekeeping:  There is no daily housekeeping service, though it is professionally cleaned between tenants.  Linens and towels are included in the house and they are counted at the end of the rental period.   We suggest you bring beach towels.

• Fireplace:  The fireplace is a non-vented propane gas log fired firebox.   Please do not throw any paper or other combustible materials in the fireplace.

• Water and Septic:  The property uses city water, but has a septic system.  The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at anytime. If it is found that feminine products have been flushed and clog the septic system, you could be charged damages.

• Bicycles and sports gear:  The Tenant will be responsible for keeping the three bicycles, helmets, volleyball, basketball, and other beach items securely locked in the shed or with the bicycle lock when not in use.  Any lost or negligent damages will be charged to the Tenant.

5.  Storms:  If there is a storm or hurricane, no refunds will be given and it is the tenant’s responsibility to acquire travel insurance (see para 11).

6. Access:  Guest shall allow Homeowner access to the property for purposes of repair and inspection.  Homeowner shall exercise this right of access in a reasonable manner.

7.  Rental Rate and Fees

• Rental Rate:  Will be the official price quote send by Homeowner to the Guest that is agreed upon.

• Cleaning Fee:  Cleaning is included in the weekly rental charge.  However, if property is left in an excessively dirty and/or disorderly condition, then additional fees will be charged to Guest’s credit card for our Housecleaner to put the property back into proper condition.

• Deposit: A deposit of one half of the total agreed upon price is due at the time of booking and the remainder is due at least 60 days prior to the Check-In Date.  If the booking date is already 60 days from the Check-In Date, then the entire amount is due at the time of booking.

• Accidental Damage Protection (ADP):  ADP is a non-refundable insurance policy charge and replaces a traditional security deposit and covers accidental damage by Guest during stay at the property.   ADP provides up to $1,500 in protection.   This fee shall be in the official price quote sent by Ivey Coast to the Guest that must be agreed upon.   ADP does not cover:

  1. intentional acts, theft,  or gross negligence;
  2. any damage that occurs if you are in violation of the lease agreement;
  3. loss, theft or damage to any personal effects owned by you or brought to the Ivey Coast house.

• Taxes:  Must be collected for any fees charged and include both State and local.   This tax rate and the total taxes are in the official price quote sent by Homeowner to the Guest that is agreed upon.

8.  Damages:   Because damage insurance is included with the rental, Homeowners don’t require a separate deposit for security/damage.  Although we never anticipate any damage, your credit card will be used to pay for damages if not covered by the ADP.  Large items missing or damaged, i.e. electronics, furniture, will be billed at full replacement cost.  Common forms of damage, though not exclusive to this list, include:

• Broke or missing items – such as linens, towels, drywall, window, etc – beyond normal wear and tear.   An occasional broken plate or glass is considered normal wear and tear and will not be billed to the Guest.

• Charges incurred due to contraband, pets, or collection of rents or services rendered during the stay.

9. Cancellation Policy:  If Guest wishes to cancel his/her reservation, the deposit will be refunded as follows:

• 100% of rental cost if cancelled at least 61 days prior to the Check-in Date

• 50% of rental cost if cancelled between 60-31 days prior to the Check-in Date

•  0% of rental cost if cancelled less than 31 days prior to the Check-in Date

• 100% of the ADP if cancelled prior to the Check-in Date

Only a partial refund is provided for cancellations less than 61 days of arrival ~ Why? ~ Because we mainly accommodate groups of family and friends, and it is difficult to arrange a vacation for a large group within a short period of time.  However, if we can book your dates with another party, we will gladly refund your payment.

10.  Liability Waiver:   Acceptance of this rental agreement releases Homeowners from liability of all equipment, appliances, boats, bikes, children’s gear, and other household items, and makes the Guest responsible for their proper use.   Homeowner agrees to provide all equipment and appliances in good condition.   Guest assumes all risk in using Homeowners’ property, including supervising others in the rental party.

11. Additional Insurance:  We encourage all renters to purchase traveler insurance, both medical and travel cancellation.  Although we do everything possible to make your stay as pleasant and carefree as possible, we cannot control or be responsible for the weather or any other unforeseen circumstance that may affect your stay.  Below are some references you may contact to purchase such insurance.  We do not, however, advocate any particular insurance plan and do not have any profit-making business relationship with any insurance company.
